Privacy Policy

AERWEAR LLC, a Florida limited liability company doing business as AXPEP, respects your privacy. This Policy explains what personal information we collect, how we use and disclose it, how long we keep it, and the rights you have — including under the California Consumer Privacy Act as amended by the California Privacy Rights Act (“CCPA/CPRA”).

1. Information we collect

You provide directly: name, email address, postal address, and phone number; orders placed and order history; age and research-use attestations with timestamp and IP address; and any messages you send us.

Collected automatically: IP address, browser and device type, pages viewed, referring URL, and cookies covering session identifiers, age-gate consent, and cart contents.

Payment information. Card details are collected and processed directly by our payment processor. We do not receive, store, or have access to your full card number.

We do not collect sensitive personal information as CCPA/CPRA defines it, and we do not knowingly collect information from anyone under 18.

2. Sources

Directly from you; automatically from your device as you use the Site; and from our service providers (payment processor, shipping carriers).

3. Why we use it

  • To process, fulfil, and ship your orders
  • To send transactional messages — confirmations, tracking, service notices
  • To maintain the compliance and attestation records our Research Use Only Policy requires
  • To respond to your enquiries
  • To detect, prevent, and investigate fraud and abuse
  • To operate, secure, and improve the Site
  • To comply with legal obligations
  • With your consent, to send research updates and product announcements

4. Marketing email

We send marketing email only if you opt in. You may unsubscribe at any time using the link in any marketing message, or by emailing aerwearbiz@gmail.com. Unsubscribing does not stop transactional messages about orders you have placed.

5. Disclosure

We disclose personal information only to service providers (payment processing, shipping and fulfilment, hosting, email delivery, analytics — each contractually limited to using it solely to provide services to us); to legal and safety recipients where required by law, subpoena, or court order, or to protect rights, property, or safety; and to a successor entity in connection with a merger, acquisition, or sale of assets.

WE DO NOT SELL YOUR PERSONAL INFORMATION, AND WE DO NOT SHARE IT FOR CROSS-CONTEXT BEHAVIOURAL ADVERTISING, as those terms are defined by the CCPA/CPRA. We have not done so in the preceding twelve months.

6. Retention

  • Order and transaction records — 7 years (tax and accounting)
  • Age and research-use attestations — 7 years (compliance evidence)
  • Account information — until you close your account, then 30 days
  • Marketing list membership — until you unsubscribe, then 30 days
  • Website analytics and server logs — 26 months
  • Support correspondence — 3 years

We may retain information longer where a legal obligation, dispute, or investigation requires it.

7. Your CCPA/CPRA rights

If you are a California resident you have the right to know what personal information we collect and why; access a copy of the specific pieces we hold; delete personal information, subject to legal exceptions; correct inaccurate information; opt out of sale or sharing (we do not sell or share, but the right stands); limit use of sensitive personal information (we do not collect it); and non-discrimination — we will not deny service, charge different prices, or provide lesser service because you exercised a right.

Residents of other states with comparable privacy laws may have similar rights, and we will honour requests on the same basis.

8. How to exercise your rights

Email aerwearbiz@gmail.com with the subject line “Privacy Request”, telling us which right you wish to exercise.

Verification. We will ask you to confirm details we already hold — typically the email address on your order and an order number — so we can be confident we are not disclosing your information to someone else. We will not ask for more than we need.

Authorized agents. An agent may submit a request on your behalf with written authorization signed by you; we may also contact you directly to confirm.

Timing. We confirm receipt within 10 business days and respond within 45 calendar days. If we need more time we will tell you, and may extend by a further 45 days.

Cost. Free, unless a request is manifestly unfounded or excessive, in which case we will explain before proceeding.

9. Cookies

We use cookies to keep you signed in, remember your age-gate confirmation, maintain your cart, and understand how the Site is used. You can block or delete cookies in your browser settings; some Site functions will not work if you do. Our age-gate consent cookie expires after 30 days.

10. Security

We use administrative, technical, and physical safeguards appropriate to the sensitivity of the information we hold, including TLS encryption in transit and access controls. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. Children

The Site is not directed to anyone under 18, and we do not knowingly collect their information. If you believe a minor has given us personal information, contact aerwearbiz@gmail.com and we will delete it.

12. Third-party links

The Site may link to third-party websites. We are not responsible for their privacy practices, and this Policy does not apply to them.

13. Changes

We may update this Policy. The effective date above will change, and we will post material changes on the Site.
